Tendance fruit SA Terms and Conditions
Article 1 – Scope
These terms and conditions govern all orders placed with Tendance Fruit SA. They form an integral part of the contract or contracts of sale between Tendance Fruit SA and the customer.
Article 2 – Tendance fruit SA Services
2.1 Tendance fruit SA sells and provides home delivery of fresh, high-quality fruit. 2.2 The products sold are described on the website, www.tendancefruit.ch. 2.3 Orders can be placed on the www.tendancefruit.ch website and by email to the following address: email@example.com, 7 days a week. Telephone orders can be placed between the hours of 8 am and 5 pm Monday to Friday and 8 am and 12 pm on Saturdays. 2.4 Tendance fruit SA undertakes to process requests received as soon as possible. 2.5 Photographs are not contractually binding. 2.6 The container and/or the contents are subject to change depending on availability.
Article 3 – Prices
3.1 The prices applicable are those shown on the www.tendancefruit.ch website at the time customers place their orders. 3.2 Prices are shown net, in Swiss francs, including VAT.
Article 4 – Finalisation of the sale and payment
4.1 The sale is finalised once the customer has placed an order and it has been accepted by Tendance fruit SA. 4.2 Orders placed on the www.tendancefruit.ch website or by email are accepted by Tendance fruit SA as soon as an email confirmation is sent. 4.3 Payment for items purchased from Tendance fruit SA may be made by bank credit card (VISA or MASTERCARD) or by bank credit transfer (invoice). (Please contact us for this payment mothod) 4.4 Payment is due at the time of order if made by bank credit card or within 30 days from date of invoice if payment is by bank credit transfer. 4.5 Tendance fruit SA does not have access to confidential information relating to bank credit card payments. The information captured is encrypted and sent to Datatrans using a secure method without being accessed by Tendance fruit SA or third parties.
Article 5 – Delivery by Tendance fruit SA
5.1 Products are delivered by Tendance fruit SA in the cantons of Vaud and Geneva, from 9 am to 6 pm, Monday to Friday. Telephone orders placed before 2 pm may be delivered on the same day if possible. 5.2 Tendance fruit SA makes no deliveries on Sundays, nor on national or canton of Vaud public holidays. 5.3 Products are delivered to the delivery address stated by the customer during the ordering process. 5.4 Tendance fruit SA assumes no liability and shall pay no compensation if incomplete or incorrect information provided by the customer prevents delivery being carried out properly or renders this impossible. 5.5 Any charges for a second delivery necessitated by incomplete or incorrect information being provided by the customer shall be borne by the customer. 5.6 In the event of the customer being absent at the time of delivery by Tendance fruit SA, the order is, unless otherwise stipulated by the customer, deposited outside the door of the apartment block corresponding to the delivery address or, if possible, the apartment door. Clients can designate a neighbour living in the same apartment block who will take delivery of the goods in their absence by giving this person’s address and telephone number when ordering. In the event of this neighbour being absent, the order is left outside the door of the apartment block or of the customer’s apartment. 5.7 Tendance fruit SA has fulfilled its delivery obligation once it has given the order to the customer or to the person designated by the customer in the event of absence, depositing it at the delivery address given. Risks are transferred to the buyer on delivery or depositing of the order.
Article 6 – Delivery by the Swiss Post
6.1 All our range is available throughout Switzerland via Swiss Post services (execept le petit/grand épicurien) 6.2 Tendance fruit SA ensures that packages are dispatched between the hours of 9 am and 2 pm, Monday to Friday, depending on time of order. A table summarising the postal delivery options and the rates applicable is available on the site (see Delivery menu). This table is for information purposes only and is not binding on Tendance fruit SA. 6.3 Tendance fruit SA makes no postal deliveries on Sundays, nor on national or canton of Vaud public holidays. 6.4 The Swiss Post’s terms and conditions applicable at the time of order shall apply to deliveries made by post, including depositing and picking up items. 6.5 Products are dispatched to the delivery address stated by the customer during the ordering process. 6.6 Tendance fruit SA assumes no liability and shall pay no compensation if incomplete or incorrect information provided by the customer prevents postal delivery being carried out properly or renders this impossible. 6.7 Any charges for a second postal delivery necessitated by incomplete or incorrect information being provided by the customer shall be borne by the customer. 6.8 Risks are transferred to the customer on dispatch of the package to the post office by Tendance fruit SA.
Article 7 – Guarantee in the event of defective goods; returns
7.1 If any product delivered is defective, Tendance fruit SA undertakes to exchange it subject to the customer adhering to the terms and deadlines set out in the following paragraphs. 7.2 Customers must make any claim on Tendance fruit SA by telephone on 0800 800 055 immediately and at the latest within 48 hours with effect from the delivery date, either of the goods delivered or deposited by Tendance fruit SA or of dispatch of the package in the event of a postal delivery. 7.3 Within the same deadline, the defective product delivered by post must be returned, in its original packaging and at the customer’s cost, to Tendance fruit SA, Chemin du Coteau 25, 1123 Aclens, which undertakes to dispatch a replacement product on receipt of the package. 7.4 Any product delivered by Tendance fruit SA must be returned to it in its original packaging on delivery of the replacement product.
8.1 Use of the www.tendancefruit.ch is authorised for private usage only. Any commercial usage, particularly for the purpose of reselling products purchased on the site to third parties, is forbidden. 8.2 Any infringement of this obligation shall be sanctioned by immediate, definitive exclusion from the customer base. The right to assert a claim for damages remains intact.
Article 9 – Data protection
Tendance fruit SA complies with the applicable legislation, and in particular with data protection law, when using customer data. Tendance fruit SA only processes and retains the data required for the provision and invoicing of its services.
Article 10 – Amendments to the terms and conditions
10.1 These terms and conditions may be amended by Tendance fruit SA at any time. 10.2 It is the customer’s responsibility to obtain information about the contents and any amendments to these terms and conditions on a regular basis by visiting the www.tendancefruit.ch website.
Article 11 – Law and Jurisdiction
11.1 The relationship between Tendance fruit SA and the customer is governed by Swiss law. 11.2 For any disputes relating to the relationship between Tendance fruit SA and the customer, the place of jurisdiction shall be the registered office of Tendance fruit SA.
